I understand that I am solely responsible for any harm caused by my bird(s) while my bird(s) is/are pet sitting or any activities with Bird Sitting Toronto. I assume all related risks, both known or unknown to me, of my participation in this service.

I also understand and agree that in releasing my bird(s) in Bird Sitting Toronto’s care, Bird Sitting Toronto has relied upon my representation that my bird(s) is/are in good health and have not harmed or shown aggressive or threatening behavior towards any person or any other bird.

I further understand that if I permitted bird interaction in the application, minor cuts and scratches can occur even though the birds are carefully supervised at all times.

While my bird(s) is/are in the care and custody of Bird Sitting Toronto, if I am unreachable in the event of an emergency, I hereby authorize Bird Sitting Toronto, its agents, and/or representatives to seek immediate veterinary care for my bird. I agree to be financially responsible for any and all costs in connection with veterinary, medical or other treatment. I am aware and understand that I should carry my own pet insurance.

I hereby release and agree to save and hold harmless, Bird Sitting Toronto, it’s directors,

officers, shareholders, employees, assistants, members and agents from any and all liability, claims, including claims of Bird Sitting Toronto’s negligence, suits, actions, loss, injury or damage of any nature or kind, or for any liability, claims, suits, actions, loss, injury or damage which I or my bird(s) may sustain or which may be caused in any way by my bird(s). I specifically, without limitation, agree to fully indemnify Bird Sitting Toronto for any and all such liability, claims, suits, actions, losses, injury or damage.

I certify that I have read and understand the rules and regulations set forth herein and that I have read and understand this agreement. I agree to abide by the rules and regulations and accept all the terms, conditions and statements of this agreement and confirm the truthfulness of the contents of the Application form completed by me.

Absenteeism

Should I have not been in contact with Bird Sitting Toronto for 14 days after the agreed upon pick up date. Bird Sitting Toronto reserves the right to find alternative care for my bird.

Social Media

By signing below, I consent to and give Bird Sitting Toronto and its representatives, Samantha Khela and Amir Khela permission to take and create photographs, images, videos, recordings, quotes, summaries, biographies, and/or excerpts of and about me (collectively called the “Media”).

I give permission to Bird Sitting Toronto to use and re-use, publish, distribute, and/or broadcast the Media, in whole or in part, individually or in conjunction with other photographs, images, videos, text, quotes, summaries, biographies, and/or excerpts, in any and all promotional, educational, business, trade, advertising and marketing materials, including, but not limited to, in connection with product endorsements. These materials may include emails, the Internet, social media, websites, and other electronic media, as well as traditional radio, television, cable television, newspaper, magazine, direct mail, catalogs, brochures, advertisements, promotional materials, press releases, training materials, and other uses, in such medium and formats (whether now known or hereafter created or invented), at such locations, at such times and for such purposes as Bird Sitting Toronto chooses, in its sole discretion.

The Release is given without payment or other consideration.

I hereby waive any right that I may have to inspect or approve the finished product or products or the advertising copy or printed matter that may be used in connection with the Media or the use to which the Media may be applied. In addition, I waive all rights that I may have to any claims for payment of any kind, whether money, property or otherwise, related to the recording production, publication, use or re-use of the Media.

I understand that this Release applies in perpetuity. I have read the above authorization, release and agreement, before signing it, and I am familiar with it and understand what it means.

I represent that I am at least 18 years of age and am fully competent to sign this release.
